COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY

As a willing participant in Music Together® classes with City Sing And Play, my family and I agree to the following:

ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at St Matthew’s Lutheran, Arena Stage at the Mead Center for American Theater, and City Sing And Play, and present an inherent risk that cannot be eliminated. I acknowledge that, although City Sing And Play is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together^® teachers, and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children. I understand and agree that as a registered family with City Sing And Play, I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases. 

WAIVER OF LIABILITY: I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue City Sing And Play and/or St. Matthew’s Lutheran, and/or Arena Stage at the Mead Center for American Theater and their owners, managers, contractors, members, employees, agents, and volunteers, for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties and claims that arise from my own and others’ actions and omission.

RELEASE FOR MEDIA USE: For designated free demo classes, by registering for and attending the event hosted by City Sing And Play, I acknowledge I am entering an area where photography, audio and video recording may occur. My entry and presence on the event premises constitutes my consent and consent on behalf of any and all participants with me, including, but not limited to minors, to be photographed, filmed, and/or otherwise recorded and to the release, publication, exhibition, or reproduction of any and all recorded media of my/our appearance, voice, and name for any purpose whatsoever in perpetuity in connection with City Sing And Play, including, by way of example only, use on websites, in social media, news and advertising. By agreeing and entering the event premises, I waive and release any claims I may have related to the use of recorded media of myself and accompanied minors at the event, including, without limitation, any right to inspect or approve the photo, video or audio recording, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such record media. I understand that all photography, filming and/or recording will be done in reliance on this consent. 

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT CITY SING AND PLAY, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.
